இந்த வழக்கு patent prosecution மற்றும் patentability தொடர்பாக முக்கியமான வழக்காகும். Patents Act, 1970-ன் Section 3(m) கீழ், ஒரு mere scheme, rule அல்லது method of performing a mental act அல்லது method of playing a game patentable அல்ல என்ற விதியின் பொருள் மற்றும் அதனை Patent Office எவ்வாறு பரிசீலிக்க வேண்டும் என்பது இவ்வழக்கில் விவாதிக்கப்பட்டது. T-Mobile International, “Method and Arrangement for optimising the Operational Times and Cell Change Performance of Mobile Terminals” என்ற தலைப்பில் patent application ஒன்றை தாக்கல் செய்திருந்தது. அந்த patent application-ஐ Controller, Patents Act-ன் Sections 3(k) மற்றும் 3(m)-ன் கீழ் objections காரணமாக நிராகரித்திருந்தார்.
இந்த முடிவை எதிர்த்து matter High Court-க்கு appeal ஆக வந்தது. வழக்கை பரிசீலித்தபோது, Section 3(m)-ல் குறிப்பிடப்பட்டுள்ள “mental act” objection-ஐ Patent Examiner எந்த முறையில் மதிப்பீடு செய்ய வேண்டும் என்பதற்கான தெளிவான judicial அல்லது administrative framework போதுமான அளவில் இல்லை என்பதை Court கவனித்தது.

நீதிமன்றத்தின் கண்டறிதல்கள் (FINDINGS):
Section 3(m) என்பது தனித்துவமான மற்றும் independent exclusion என்று Court தெளிவுபடுத்தியது. ஒரு claim-ன் ஏதேனும் ஒரு step-ல் human reasoning, calculation, evaluation அல்லது decision-making இடம்பெறுகிறது என்பதற்காக மட்டும் அந்த claim-ஐ Section 3(m)-ன் கீழ் நிராகரிக்க முடியாது.
முழுமையான claim-ஐ as a whole என்ற அடிப்படையில் பரிசீலிக்க வேண்டும். அந்த claim வழங்கும் monopoly உண்மையில் ஒரு mental act-ஐ மட்டுமே பாதுகாக்கிறதா என்பதே முக்கியமான கேள்வியாகும்.
மேலும், physical means தேவைப்படுவது, hardware மற்றும் software ஆகியவை ஒன்றோடொன்று technical manner-ல் செயல்படுவது அல்லது tangible technical result கிடைப்பது போன்ற சூழ்நிலைகளில் Section 3(m) objection பொருந்தாமல் இருக்கலாம் என்று Court விளக்கியது.
பரிந்துரை (SUGGESTION):
Patent drafting மற்றும் prosecution செய்யும்போது claims-ல் technical implementation, physical components, hardware-software interaction மற்றும் tangible technical output ஆகியவை தெளிவாக வெளிப்படுமாறு drafting செய்ய வேண்டும்.
Section 3(m) objection வந்தால், invention முழுமையாகப் பார்க்கும்போது அது வெறும் thinking, calculating, judging அல்லது deciding ஆகிய மனச்செயல்களை மட்டுமே monopolise செய்யவில்லை என்பதை தெளிவாக விளக்க வேண்டும்.
மேலும், Section 3(m) objection-ஐ Sections 2(1)(j) மற்றும் 2(1)(ja) ஆகிய novelty மற்றும் inventive step requirements-லிருந்து தனியாக அணுகுவது முக்கியம்.

Section 3(m) objection-ஐ பரிசீலிக்கும்போது claim-ஐ செயற்கையாகப் பிரித்து ஒரு mental step-ஐ மட்டும் தனியாகப் பார்க்கக்கூடாது. முழு claim-ஐ பரிசீலிக்க வேண்டும். Physical implementation, technical components-ன் interaction அல்லது tangible result போன்ற அம்சங்கள் இருந்தால், அந்த claim Section 3(m) exclusion-க்கு வெளியே இருக்கக்கூடும்.
